These Terms of Service ("Terms") govern your use of http://ownversion.com and any related services provided by OwnVersion ("OwnVersion", "we", "us"), together the "Service". By using the Service or creating an account, you agree to these Terms. If you don't agree, please don't use the Service.
1. The Service
OwnVersion makes software: apps for Mac and iPhone, and web apps that we run as a private instance for each customer, so you get your own version of the software without hosting or maintaining it yourself. Today the Service consists of information about our apps, a directory that compares popular software, and user accounts.
Our apps, including OwnVersion Analytics and OwnVersion Toolkit, are not yet available. The Service labels them "In development" or "Planned". When an app or the membership launches, it may come with additional terms, such as pricing, service levels, app store terms and data processing terms, which we will show you before you use it.
2. Your account
- You must be at least 16 years old, and old enough to form a binding contract where you live, to create an account.
- Give us accurate information and keep it up to date.
- Keep your password confidential. You are responsible for activity on your account. Tell us right away at [email protected] if you think someone else has accessed it.
- An account is for one person. Don't share it or create accounts by automated means.
3. Acceptable use
When using the Service, you agree not to:
- break the law or infringe anyone's rights;
- try to get around security measures, rate limits or access controls, or probe or scan the Service for vulnerabilities without our written permission;
- interfere with or disrupt the Service, or put an unreasonable load on its infrastructure;
- scrape, copy or harvest the Service by automated means, except as allowed by our
robots.txt, or use the catalog to build a competing database; - upload or transmit malware or other harmful code;
- impersonate anyone or misrepresent your affiliation with anyone.
4. Catalog information
The catalog is provided for general information. We review listings and work to keep them accurate, but software changes often, and listings can be incomplete, out of date or wrong.
- Licenses, prices and features belong to each product's owner and may change without notice. Check them with the vendor before you rely on them.
- Our classifications, such as "equivalent", "functionally similar" or "partial alternative", are editorial judgements, not guarantees that one product can replace another.
- A capability that isn't shown for a product hasn't been verified by us. It doesn't mean the product lacks it.
- Product names, logos and trademarks belong to their owners. A listing doesn't mean the owner endorses, sponsors or is affiliated with OwnVersion, or that we endorse the product.

5. Our apps and third-party software
OwnVersion apps are built and owned by OwnVersion. When they launch, a membership will give you the right to use our apps, including your instance of each web app, while your membership is active. Some app features may be free to use without a membership. You will own the data you create with our apps, and the software itself remains ours.
The other software described in our directory is created and licensed by other people. Nothing in these Terms gives you a license to any third-party software, and your use of it is governed by its own license.
6. Our content
The Service's design, text, artwork, catalog compilation and software are owned by OwnVersion or its licensors and are protected by intellectual property laws. We give you a personal, non-exclusive, non-transferable and revocable permission to use the Service for its intended purpose under these Terms.
If you send us feedback or suggestions, you allow us to use them without any obligation to you.
7. Fees
The Service is currently free to use. If we introduce paid services, we will show you the price and any applicable terms before you buy. You won't be charged without agreeing first.
8. Privacy
Our Privacy Policy explains how we handle personal information when you use the Service.
9. Suspension and termination
You can stop using the Service at any time, and you can ask us to delete your account by emailing [email protected].
We may suspend or close your account if you break these Terms, if we need to in order to protect the Service or other users, or if the law requires it. Where reasonable, we'll tell you first. Sections that by their nature should survive termination, including sections 4 to 6 and 10 to 13, will continue to apply.
10. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the Service will be uninterrupted or error-free, or that catalog information will be accurate or complete.
11. Limitation of liability
To the fullest extent permitted by law, OwnVersion will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from your use of the Service.
Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us for the Service in the 12 months before the claim, or 100 US dollars.
Some jurisdictions don't allow certain of these limitations, so they may not all apply to you. Nothing in these Terms limits liability that can't be limited by law.
12. Indemnity
You agree to indemnify and hold OwnVersion harmless from claims, losses and expenses, including reasonable legal fees, that arise from your breach of these Terms or your misuse of the Service.
13. Governing law and disputes
These Terms are governed by the laws of the place where OwnVersion is established, without regard to conflict-of-law rules. If you are a consumer, you also keep any protections that the law of the country where you live gives you and that can't be waived by contract.
14. Changes to these Terms
We may update these Terms from time to time. We will change the effective date at the top of this page. If a change is significant, we will let account holders know before it takes effect. If you keep using the Service after a change takes effect, you accept the updated Terms.
